Terms and Conditions

  1. ​Ownership

    1. This website is owned and operated by Ōmataroa Eco Tours and its parent company OMR2 Holdings Limited Partnership. These terms and conditions set forth the terms and conditions under which you may use our website and/or purchase and attend the services/tours as offered by us. By accessing and/or using our website you approve that you have read, understood, and agree to be bound by these terms and conditions.

    2. In order to use our website and/or receive our services/tours, you must be at least 18 years of age, and possess the legal authority, right and freedom to enter into a binding agreement. You are not permitted to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

  2. Bookings/Purchases

    1. When booking/purchasing a service/tour from us you agree that;

      1. you are responsible for reading the service in full before making a commitment to purchase it and;

      2. you enter into a legally binding contract when you complete the payment process.

    2. The prices listed on this website are in New Zealand currency and are exclusive of sales tax (known as GST or goods and services tax).

    3. The listed price may vary from payment price due to sales tax, transaction and exchange rate fees.

    4. Payment must be made in full at time of booking/purchase unless other arrangements are agreed between you and us.

    5. Full payment made by you acts as a warranty that you and those included in your booking meet requirements to attend the service/tour purchased.

    6. Bookings/purchases are confirmed once payment in full has been received by us.

    7. We reserve the right to change our prices at any time and to correct pricing errors that may inadvertently occur.

  3. ​Cancellation and Refunds

    1. We invest a lot of effort and energy into bookings/purchases once confirmed. We acknowledge that cancellations may occur and our policy is as follows:

      1. Day tours/experiences:

        1. More than 14 days before the experience date: 95% refund (5% service fee retained).

        2. 8-14 days before the experience date: 50% refund.

        3. 2-7 days before the experience date: 25% refund.

        4. 1 day or within 24 hours before the experience date: No refund.

      2. Overnight tours/experiences:

        1. More than 30 days before the experience date: 95% refund (5% service fee retained).​

        2. 15-30 days before the experience date: 50% refund.

        3. Within 14 days of the experience date: No refund.

    2. ​All cancellations must be advised in writing.

    3. If we are unable to provide your confirmed service/tour through our own fault, excluding ‘force majeure’, we will offer the following in order:

      1. Voucher of equivalent value for future use; then

      2. refund less 5% administration fee.

    4. ‘Force majeure’ is any event which we could not, even with all due care, foresee or avoid. Such events include, but is not limited to, war or threat of war, riots, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, fire, pandemic and all similar events outside our control.

    5. To safeguard you in the event of having to cancel or change your booking for anything unexpected, we strongly encourage you to hold a comprehensive travel insurance policy.

  4. Changes

    1. We will take all reasonable steps to provide your confirmed service/tour as advertised, however, should there be circumstances that require us to modify the service/tour, we reserve the right to do so.

    2. We will not modify any confirmed service/tour if you and/or those included in your booking:

      1. do not arrive at the start point on time; or

      2. shorten the service/tour or opt out of activities, for any reason.

      3. In such circumstances, no refund will be given.

  5. Liability

    1. Ōmataroa Eco Tours accept no responsibility for injury, damage or loss of personal possessions, except where there is legal obligation to do so.

    2. Full payment made by you confirms that you, and those included in your booking, hereby release, waive, discharge, hold blameless and indemnify Ōmataroa Eco Tours and all persons entities and contractors connected to Ōmataroa Eco Tours, from any and all liability for death, disability, physical or mental injury, property damage, theft or loss of personal items and all other foreseeable risks, claims or actions of any kind whatsoever and however occurring which may arise, at any time, from or in connection with, directly or indirectly, as a consequence of you carrying out an experience, tour, or service with us.

    3. You agree to indemnify and hold Ōmataroa Eco Tours and its parent company OMR2 Holdings Limited Partnership harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of this website or any of the services/tours offered.

  6. Security and Privacy

    1. Ōmataroa Eco Tours is committed to ensuring that your personal information is secure, and protects that information from misuse or loss, and from unauthorized access, modification or disclosure.

    2. Total security of data cannot be guaranteed when transmitted over the internet as there are influencing factors beyond our control. As such we do not warrant security of information transmitted over the internet.

    3. When providing personal information you acknowledge that you do so at your own risk. Your personal information is used for the following purposes:

      1. To verify your identity and process any bookings/purchases.

      2. To inform or offer the most relevant information suitable to you.

      3. For marketing, research, promotion or publicity activity that we undertake.

      4. For any other purpose that you authorize.

    4. We do not sell, or allow third parties access to your information without your authorization except where it is required by law.

    5. You may request access to your personal information at any time.

    6. If you believe that your personal information has been compromised you confirm that you will notify us immediately.

    7. We may use information collected by cookies to:

      1. Track website traffic patterns; and/or

      2. ensure to display the most relevant content when you visit our website; and/or

      3. allow you to use certain services on this website.

  7. Intellectual property, copyrights and logos

    1. ​The content on this site is protected by copyright and no part of this site may be reproduced or adapted in whole or in part without our prior consent. All rights in this site are owned by Ōmataroa Eco Tours and its parent company OMR2 Holdings Limited Partnership.

  8. New Zealand Law

    1. Unless otherwise specified, the content on this site has been prepared in accordance with New Zealand law for the supply of services/tours in New Zealand only. The content of this website and any contracts formed with us arising out of this site are governed by, and are to be interpreted in accordance with New Zealand law and where New Zealand courts have jurisdiction.​

  9. Health Safety and Risk

    1. You agree to disclose, at time of booking/purchase, any medical details that may adversely affect your, and those included in your booking, participation. Such medical conditions may include but is not limited to, allergies, asthma, pregnancy, chronic conditions, muscle strain, heart issues and body aches.

    2. Special dietary requests must be advised at time of booking/purchase. We will endeavor to meet special requests, however, if we are unable to do so, we will contact you to agree upon alternate arrangements.

    3. Ōmataroa Eco Tours reserves the right to cancel or remove you and/or those included in your confirmed service/tour if health, fitness and/or behaviour is a concern that it may interfere with the service/tour and/or public safety in any way.

  10. Marketing

    1. You agree to receive promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you do not want to receive such promotional materials or notices you confirm that you will notify us. 

    2. We reserve the right to use photographs or videos taken of you experiencing your confirmed service/tour for promotional purposes. This may include, but is not limited to use online, in printed material or at public events.

  11. Ōmataroa Eco Tours reserve the right to modify these terms and conditions at our sole discretion.
